The Employment Appeal Tribunal (EAT) has ruled that 'pre-cancerous' cells could be classed as cancer for the purposes of the Equality Act 2010 (Source: www.peoplemanagement.co.uk).  This means that staff who take time off work to have treatment for pre-cancerous conditions may be classed as disabled and therefore protected under the Equality Act. 

 

What does this mean if you have employees who need to take time off for medical treatment in these circumstances?

You should always seek advice from their GP before taking any action to ensure that you are acting in the most appropriate manner.
