Your HR team is lovely. Managers are kind. Handbook ticks all the boxes.And you're still at risk of sex discrimination.That’s exactly what happened to Elders’ Voice v Ms Andrea Tanguy (2021).
A female employee won an indirect sex discrimination claim.
Why?
Not because HR were absent.
Not because policies were missing.
Not because someone meant to discriminate.
But because the employer enforced a working pattern that disproportionately impacted women with childcare responsibilities.
And they didn't realise they were doing it.
Because how could they?
The tribunal made it very clear;
HR’s “neutral” policy disadvantaged women -and no legitimate justification could be shown.
They didn’t intend to discriminate.
But the risk was hidden in plain sight.
Let me be clear - They followed all the right processes -
But none of that stopped the loss.
Because their processes dealt with the surface, as most do.
They didn’t DIAGNOSE the risk.
This is why we talk about gender equity the way we do.
Not because we think employers are evil.
But because you can lose without ever realising you did something wrong.
And you most likely are doing something wrong.
FYI, indirect discrimination is the most dangerous kind for employers;→ You never know its there
→ Nobody ever looks for it until they're sued
→ You likely won't even notice it if it stared you in the face.
And you don't need to break the law to be found guilty.
You just need to ignore the invisible risks underneath it all.
