There are many considerations, such as parental stability, the child's relationship with both parents, and living situations overall. Knowing what are the most applicable factors that will have an impact on custody orders will enable parents to develop a solid case and move closer to having an arrangement that is best for the emotional and physical health of their child. 

Parental Capability and Stability:

Financial stability, emotional stability, and overall responsibility are assessed by courts to ascertain the ability of the parent to care for their child. A parent with difficulty in finding a job, keeping a house, or with personal issues may be deemed less suitable for primary custody. Judges also consider if parents have experienced a history of mental illness or drug addiction. 

Child's Preference:

The child's choice is sometimes considered by the court, especially if the child is of reasonable age and maturity. While the young child will not be of much voice on the matter, older children will be able to express how they feel about the preferred parent. Judges weigh the child's argument and if their choice is due to true concern or external influence. The existing relationship between the child and both parents comes into play while deciding on custody. If a parent has been the sole provider, the court may favor that parent to have continuity in the child's life. The setting a child gets in both parents is a major determiner when granting custody. Courts evaluate factors such as the neighbourliness, security, and functionality of the living space available. If a parent can provide a stable and more comfortable home, they are most likely to be given custody. 

Stability in education and friendship is also considered for the child at their current education and social circle. Any history of domestic violence, extensive moving, or unstable home will be detrimental to a parent. Ensuring safety, care, and stability while providing a healthy environment is more important than any other factor while determining custody terms.

Cooperation Between Parents and Capability for Co-Parenting:

Courts desire cooperative parents and a healthy co-parenting relationship. If a parent is combative, defiant, or attempts to alienate the child from the other parent, it jeopardizes their custody case. Judges determine whether both parents respect the agreement on custody and put the child's emotional interest first over differences between them. 

The ability to resolve conflicts amicably and ease the relationship between the child and the other parent is important. Joint custody cases are most preferred by the courts when there is evidence of interest from both parents in cooperatively acting in the best interests of the child. Cooperation and flexibility are significant considerations in custody determinations. 

Any History of Domestic Violence or Neglect:

A history of abuse, neglect, or domestic violence significantly impacts custody determinations. Courts prefer the safety of the child and may grant sole custody to the non-abusive parent. In instances of a parent who has a background of physical, emotional, or psychological abuse against the child or the other parent, their custodial rights are suspended or even terminated. 

In cases where safety concerns are raised, judges are also authorized to issue orders of supervised visitation. Evidence in the form of police testimonies, medical professional testimonies, and witnesses' testimonies are generally considered in such instances. The ultimate goal is to place the child in a safe and nurturing setting with no harm.

Child custody determinations are complex and premised on multiple factors that attempt to act in the best interest of the child. Parental stability, the preference of the child, relationships available, and overall living conditions are determined by courts in arranging custody.
